Environmental Law

The Environmental Law class will introduce students to the “nuts and bolts” of U.S. environmental law, with a focus on the most important United States Supreme court cases addressing environmental law issues. We begin with longstanding principles of the common law and then expand to consider the major federal statutes that have come to dominate the field. Using the statutory text and associated regulations, we will analyze the regulatory regimes governing air and water pollution, hazardous waste, and toxics. We will study some of the most hot-button issues in the field, including endangered species protection, environmental review, and climate change. We will also learn the practical, problem-solving art of navigating a complex field of law, and how agencies use the regulatory process to enact goals that may—or may not—comport with the statutory regime in which they operate.
